21st Century Cures Act

The 21st Century Cures Act are rules requiring electronical access to all of their electronic health information (EHI), structured and/or unstructured, at no cost. The rules will go into effect on April 5, 2021.

Due to the Cures Act, all orders will now have the question “Release To Patient”. Immediate release will be defaulted. This will immediately release the result to kp.org. If you select manual release only, you must enter a reason.

Cures Act Exceptions:

  • If the patient requests confidentiality.
  • If you believe it is reasonable and necessary to PREVENT HARM to a patient or another person, provided certain conditions are met.
  • Pathology/Cytology will be delayed for 3 days prior to release.
  • Test results prohibited by state law (None in Colorado/HIV is NOT protected by CO state law so will be released similar to other labs).
